1 Validity of the GTC and conclusion of the contract
1.1 These General Terms and Conditions (GTC) shall apply to purchase contracts with specialist dealers concluded with ESKITEX AG via the www.myeskimo.ch websites.
1.2 For purchase contracts concluded by other means, e.g. by telephone or letter, these GTC shall also apply. The customer shall be informed in the checkout/checkout where he can read and print out the GTC on the Internet.
1.3 Resale of Eskimo branded products to B2B customers is only allowed via Eskitex AG.

2 Prices
2.1 All prices are quoted in CHF. The statutory VAT (currently 7.7 %), is not included and is listed separately.
2.2 The supplier reserves the right to change prices at any time. For the customer, the prices published on the website on the order date shall apply.
2.3 Information on any promotions and discounts is noted with the relevant products.

3 Delivery terms
3.1 Delivery of the order shall be made in accordance with the information provided with the individual products. The Supplier undertakes to dispatch the order as quickly as possible.
3.2 Orders of CHF 200.00 or more are free of postage in Switzerland and the Principality of Liechtenstein. For orders up to CHF 199.00 we charge postage of CHF 15.00. At present we deliver goods only within Switzerland and Liechtenstein. 

 
4 Liability and complaints
4.1 The customer must inspect the delivered goods as soon as possible and report any defects to customer service immediately. The customer service can be reached under the link Contact. The making of a payment shall not be deemed to be a waiver of notice of defects. 
4.2 If there is a defect, the customer has the right to demand that the defect be remedied free of charge. If it is not possible to remedy a defect, a replacement delivery shall be made. Defects such as wear and tear, improper handling, excessive stress or external environmental influences are excluded from the warranty.

 
5 Fulfilment of the contract
5.1 By clicking the button "Buy now", the customer concludes a binding order with Eskitex AG for the goods contained in the shopping basket.
5.2 Our confirmation shall be decisive for the scope and execution of the delivery. Unless expressly agreed otherwise, benefit and risk shall pass to the customer upon dispatch of the goods from the sender. 
  
6 Payment
6.1 Payment is possible by invoice.

7 Liability for online connections
7.1 The supplier undertakes to ensure security in accordance with the current technical state of the art in systems, programmes etc. which belong to him and over which he has influence, and to comply with the rules of data protection.
7.2 The Customer shall ensure the security of the systems, programmes and data within its sphere of influence. In his own interest, the customer must keep passwords and user names secret from third parties.
7.3 The Provider shall not be liable for defects and malfunctions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
7.4 Furthermore, the provider is not liable for force majeure, improper action and disregard of risks on the part of the customer or third parties, extreme environmental influences, or interventions by the customer, or disruptions by third parties (viruses, worms, etc.) that happen despite the necessary current security precautions.
7.5 In the case of direct or indirect references to external websites ("hyperlinks") that lie outside the author's area of responsibility, a liability obligation would only come into force if the author had knowledge of the content and it would be technically possible and reasonable for him to prevent use in the case of illegal content. The author hereby expressly declares that at the time the links were created, no illegal content was discernible on the linked pages. The author has no influence on the current and future design, content or authorship of the linked pages. For this reason, he hereby expressly distances himself from all contents of all linked pages that were changed after the link was created. This statement applies to all links and references set within the author's own Internet offer as well as to external entries in guest books, discussion forums, link directories, mailing lists and all other forms of databases set up by the author to which external write access is possible. Liability for illegal, incorrect or incomplete content and in particular for damage arising from the use or non-use of such information lies solely with the provider of the page to which reference is made, and not with the person who merely refers to the respective publication via links.

8 Copyright and trademark law
8.1 The author endeavours to observe the copyrights of the images, graphics, sound documents, video sequences and texts used in all publications, to use images, graphics, sound documents, video sequences and texts created by himself or to use licence-free graphics, sound documents, video sequences and texts. All brand names and trademarks mentioned on the website and possibly protected by third parties are subject without restriction to the provisions of the applicable trademark law and the ownership rights of the respective registered owners. The mere mention of a trademark does not imply that it is not protected by the rights of third parties! The copyright for published objects created by the author himself remains solely with the author of the pages. Any duplication or use of objects such as diagrams, sounds or texts in other electronic or printed publications is not permitted without the author's agreement.

9 Application of law and place of jurisdiction
9.1 The contractual relationship with the customer shall be governed exclusively by Swiss law. Winterthur is expressly agreed as the place of jurisdiction.
